About Inadequate Maintenance
Inadequate maintenance claims involve injuries from hazards a property owner failed to repair, such as broken stairs, loose railings, or water leaks. These hazards are common in apartment buildings, shopping centers, and older commercial properties. In California, a property owner generally must keep the premises reasonably safe, and a claim typically requires showing the owner knew or should have known of the disrepair and did not fix it within a reasonable time. Because California follows pure comparative negligence, you may still recover even if you share some fault. Damages may include medical expenses, lost wages, and pain and suffering.
