司机对行人负有较高的注意义务，但行人也可能被认定部分责任（例如闯红灯或路中穿行）。加州的比较过失制度下，部分责任不等于不能索赔，只是按比例折减。路口监控、车速证据和目击者证言对认定影响很大，尽早保全。
