Check your own policy for uninsured/underinsured motorist (UM/UIM) coverage — it exists exactly for this situation and lets you claim through your own insurer. Suing the driver personally is possible but often hard to collect. Pull your policy's declarations page and have the coverage layers reviewed for free.
